A2P Compliance Terms and Conditions

These A2P Messaging Terms and Conditions (“Terms”) govern your use of application-to-person (A2P) messaging services provided by Yellow Mountain Business Solutions LLC (“YMBS,” “we,” “us,” or “our”). By using our services, you agree to comply with these Terms.

Definition

A2P Messaging

Messages sent from an application to an individual, including notifications, alerts, promotional messages, or similar communications.

Recipient

An individual receiving an A2P message from you via YMBS services.

Client

You or your organization using YMBS services.

Client Responsibilities

1. Consent

You must obtain and maintain explicit consent from each Recipient before sending A2P messages, including any required opt-in confirmations.

2. Compliance with Laws

You agree to fully comply with all applicable laws, regulations, and carrier guidelines, including but not limited to:

TCPA (Telephone Consumer Protection Act)
CAN-SPAM Act
GDPR (General Data Protection Regulation)
CTIA and mobile carrier codes of conduct

3. Message Content

You are responsible for the legality, accuracy, and appropriateness of all messages. YMBS does not review your content for compliance.

4. Opt-Out

Every message must clearly identify the sender and provide a simple method for Recipients to opt out of future messages.

5. Data Privacy

You are responsible for protecting Recipient data and complying with all applicable data protection laws.

YMBS Responsibilities

1. Service Standards

We provide messaging infrastructure that meets industry and regulatory standards.

2. Support & Guidance

YMBS may provide reasonable technical or compliance guidance at our discretion.

3. Monitoring

We reserve the right to monitor usage and content for compliance. Violations may result in suspension or termination of services.

4. Limitation of Liability

YMBS is not liable for penalties, damages, or claims arising from your misuse or non-compliance. You agree to indemnify YMBS against third-party claims related to your messaging.

Amendments

YMBS may update these Terms at any time. Significant changes will be communicated. Continued use of services constitutes acceptance of the revised Terms.

Termination

YMBS may suspend or terminate services for breaches of these Terms. Either party may terminate the agreement with written notice. Termination does not remove obligations incurred before termination.
